Terms of Service

These terms govern your use of Ghosty Studio and its products (the "Service"), operated by Ghosty Studio ("Ghosty", "we"). By creating an account or using the Service you accept these terms. If you do so on behalf of an organization, you represent that you are authorized to bind it.

1. Your account

• You must be of legal age and provide accurate information.
• You are responsible for activity under your credentials and for the people you invite to your workspace.
• Tell us immediately if you detect unauthorized access.

2. Plans, payments and taxes

Current plans, capacity and prices are published on the pricing page. Prices are in Mexican pesos and exclude VAT, which is added to the total. Unless agreed in writing, payments are made in advance and are non-refundable for periods already started.

Each plan includes a defined capacity — seats, parallel turns and usage balance. We may limit or suspend the service when contracted capacity is sustainedly exceeded, with reasonable prior notice.

3. Acceptable use

You may not use the Service to:

• Carry out unlawful or fraudulent activity, or infringe third-party rights.
• Generate or distribute content promoting harm, harassment, discrimination or child exploitation.
• Send unsolicited bulk messaging (spam) through any connected channel.
• Attempt to breach, probe or overload the infrastructure, or circumvent technical or billing limits.
• Scrape, replicate or resell the Service without written authorization.

You must also comply with the terms of the AI model providers and of any platform you connect.

4. Your content is yours

You retain ownership of all content you upload or generate with the Service. You grant us only the limited license needed to host, process and display it to you while you use the platform. We do not use your content to train models.

You are responsible for holding the rights and consents required over what you upload, including third parties' personal data.

5. Limits of artificial intelligence

Agents generate content automatically and may produce incorrect, incomplete or inappropriate information. Their output does not constitute legal, medical, tax or financial advice. You must review and validate any deliverable before using, signing or sending it to a third party. Decisions you make based on those results are your sole responsibility.

6. Availability and changes

We work to keep the Service available, but it is provided "as is" and without a guarantee of uninterrupted operation. We may modify, add or retire features; if a change substantially affects what you contracted, we will give you reasonable prior notice.

7. Suspension and termination

You may cancel your account at any time. We may suspend or terminate access for breaches of these terms, non-payment, or risk to the security of the platform or of third parties. Upon termination you may request an export of your content within the following 30 days.

8. Limitation of liability

To the extent permitted by law, Ghosty will not be liable for indirect or incidental damages, lost profits or data loss. Our total aggregate liability is limited to the amount you paid for the Service during the three months preceding the event giving rise to it.

9. Intellectual property

The software, brand, design and documentation of Ghosty Studio are our property. These terms transfer no rights over them beyond your use of the Service.

10. Governing law

These terms are governed by the laws of the United Mexican States. For any dispute, the parties submit to the competent courts of Mexico City, waiving any other jurisdiction.
